I am writing a nutcase letter to try to get an old paid collection removed. I did a complete name change, so the ca's records do not reflect my new name (wasnt hiding...changed my first name to a nickname I've used for years and then got married)

Now, should I put new name and the account number or the old name and the account number. My credit reports show new name and also show the former name.

I want them to know which account I'm talking about...so maybe I should put the old name...then again, I don't want them to respond, do I?...so maybe I should put the new name?

I dunno...trying to get this in the mail today.

Thanks!

Hmm...guess I can't notarize it myself (yes, I'm a notary).

Maybe I am sending the wrong nutcase...this is the one, right? Of course, I amended it to my needs.

To Whom It May Concern:

I am formally requesting that you validate all tradeline notations you have submitted to the three major credit reporting agencies by NAME OF COLLECTION AGENCY or NAME OF ORIGINAL CREDITOR for me, YOUR NAME, for account number XXXXXXXXX.

Due to possible inaccuracies in these CRA reports, I must demand that the validation I hereby lawfully request be in the form of a notarized statement by a person with original knowledge of the debt as it was constituted and who can testify that the debt was incurred legally, was not subsequently disputed as a result of returned, faulty, or recalled consumer products, was not utilized as a profit-loss tax deduction during the period it may have been payable, and was not claimed as a loss with any insuring entity during the period it may have been payable. Please be advised that I am not requesting a verification that you have my mailing address; rather, I am requesting validation, i.e., competent evidence that I had some contractual obligation sans consumer protection encumbrance which incurred the original claims associated with this tradeline.

I have enclosed two documents which will verify my address: a photocopy of a [YOUR STATE] Driver's License and a photocopy of a recent [NAME OF UTILITY OR TELEPHONE COMPANY] statement.

Please know that you have 30 days from the tracked and confirmed delivery of this lawful notice to either answer these demands or to remove the associated negative tradeline notations from the CRA reports. Any other action may constitute evidence of your intent to abridge one or more civil or other constitutional rights. Please be further advised that continued unsubstantiated reporting of possible inaccuracies to third parties may provide a basis for criminal complaints being filed in accordance with FDCPA, FCRA, and other federal statutes.

I look forward to a timely and amicable resolution to this matter.

Sincerely yours,

Actually that's the original you've got there. The updated version ("Version 2" lol) includes a reference to a legal cite. I've not seen others except the followups in the series. Here's a link to the newer one (it's attorney-reviewed and has a bunch of testimonials -- it may not work for you, who knows, but it's worth a shot regardless):

To answer the account number question, use the one that appears on your credit report -- not the actual one if it differs.

As promised a few days ago, I'll have a revised Nutcase exposition ready for Creditboards very soon. This will be a Creditboards exclusive, LOL -- you'll have to come to this board to get it. Oops, you're already here. No problem then. (Ok, I'm being silly.) With any luck you'll be a positive testimonial very soon too.

Yikes, Nikki, now I *really* wish I had my CB bit done. The Son of Nutcase is the second in the series. Go with the one I just suggested. If you don't succeed there, you'll move along to #2 (and then #3, but hopefully that won't be required).

I think I confused things when I revised the first letter in the series and called it "Version 2." I'm going to give these puppies clearer and less silly names with the iteration of the rationale I'll post to Creditboards. I like the Nutcase name because it's memorable, but the individual letters will be much more clearly named (Nutcase Letter 1, Nutcase Letter 2, etc.). There were a few other things that could have been improved, so I'm doing that too. Sorry for the confusion.

Summary: You're sending the first letter of the series -- but Version 2 of it at the link above. (Think of it like a software package -- an update.) You're not sending the second letter in the series yet. Ack, I may be making things worse. I look forward to clearer labels too.

Thanks Doc,

When I referred to son of nutcase and notarizing, I meant that will be my second letter to fire off to them...since I didn't notarize the first nutcase.

However, I will amend to use nutcase 2...since my postal meter went t*ts up on Thursday, I didnt send my letter, lol.

It was a sign  Thanks for all your help. Good to see you!

This young man I know had accounts opened by his father when he was 17. He knew about one but the other came as a surprise. Is this how he gets them validated? Apologies, I'm new to this. But thanks very much for your help.

I decided not to notarize my nutcase and I didn't even give a time limit I am using the other Psychological effect like I got you by the balls So go ahead make my day but I had to send mine to the biggest CO out there so showing I got balls was also important.

Hi everyone. Just curious- has the nutcase letter changed? I noticed that was some while ago when it was posted. Is there a newer version. Thanks for any answers.

I read somewhere that it's not a good idea to send a copy of your drivers license and utility bill to a CA. I wouldn't trust them to have that info. Will the nutcase still work without sending that?

I have used the nutcase series with great success without having it notarized or without a copy of my drivers license or utility bill. (I would NEVER send that info to a CA, but thats just me) YMMV :(

Just a thought but having a Nutcase letter notirized you're going to have to sign it in front of a notary. Hene you'll be sending these scumbacgs your signiture which I've always read here that you should never send these CA your sig and never sign your name so I'm guessing that is one of the updates on the nutcase.

Plus they would never get my license and icense number and signature in a letter to them eithr.

the rest of the letter is pure GOLD and I'm going to be using it later this weeks as soon as I find an address to one of these CA's that just popped up from 5 years ago.

Did you use puncuation in your letter?

LOL, I'm joking, of course. Just had to ask.

All in good fun:wave:

ETA: Didn't know this was a years old thread that had recently been bumped...sorry!
